Terms of Use
These terms govern the use of Voza: the website, the dashboard, the API, the webhooks and the web phone. Whoever creates an account ("customer", "you") accepts these terms, the Acceptable Use Policy, the Privacy Policy and the Data Processing Agreement, which are part of these terms.
Voza is a service for businesses. By accepting these terms on behalf of a company, you declare that you are authorized to represent it.
1. The service
Voza offers an API for software systems to send and receive WhatsApp messages and calls. Each number is linked to Voza in one of two ways:
- By QR code: a regular WhatsApp or WhatsApp Business account is connected as a linked device, like WhatsApp Web.
- Official: a number from the official WhatsApp API (WhatsApp Cloud API), in the customer's own Meta account.
The available features, the limits of each plan and how to use the API are described on the website and in the documentation, which may change over time.
2. Account, users and API keys
- The sign-up details must be true and kept up to date.
- You are responsible for everything that happens in your account: for the users you invite, the passwords and the API keys. Keep the keys only on your servers, and revoke in the dashboard any key that may have been exposed.
- Let us know as soon as you learn of any unauthorized access to your account.
3. Numbers connected by QR code
The QR code connection uses WhatsApp the same way a linked device does. It is not a Meta product and is neither supported nor guaranteed by Meta. Therefore:
- WhatsApp may limit, disconnect or ban a number at any time, especially in the case of bulk sending, unsolicited messages or reports from recipients. Voza does not control these decisions and does not guarantee that a number stays active.
- WhatsApp may change how it works without notice, which may interrupt Voza features until they are adapted.
- You take on these risks when you use numbers connected by QR code. For uses where an interruption is not acceptable, we recommend official numbers.
4. Official Meta numbers
- Official numbers follow Meta's rules, including the WhatsApp Business Policy and the Commerce Policy.
- The Meta account, its access tokens and Meta's charges for conversations belong to the customer: Meta bills the customer's Meta account directly, and the Voza plan does not include those charges.
- You are responsible for keeping valid the tokens and permissions you give Voza.
5. Acceptable use
You may only use Voza for lawful purposes, in accordance with the Acceptable Use Policy and WhatsApp's rules. You may integrate Voza into the systems you sell to your customers; in that case, you are responsible for how they use it.
6. Free trial, plans and payment
- Every new account may try Voza for 7 days, without a card, with the trial's limits. At the end of the trial, the API stops responding until the account subscribes to a plan.
- Plans are monthly and charged in advance by card, through Stripe, in Brazilian reais or US dollars. The subscription renews automatically every month until it is canceled.
- When you change plans, the difference is calculated from the days left in the period.
- Prices do not include taxes that the law of your country requires to be added to the invoice.
- If a payment fails, Stripe tries again for a few days. If the payment does not go through, the subscription ends and the API stops responding to your keys.
- We may change prices with at least 30 days' notice. The change applies from the renewal following the notice.
- Terms agreed in writing with Voza (other limits, another payment method) prevail over this section.
7. Cancellation, suspension and termination
- You may cancel the subscription at any time in the dashboard. The account stays active until the end of the period already paid for; partial periods are not refunded, except where the law requires it.
- We may suspend the account, in whole or in part, in case of a security risk, use that violates these terms or the Acceptable Use Policy, an order from an authority or lack of payment. Whenever possible, we give notice first and time to fix the problem.
- You may delete the account in the dashboard. The data is removed as described in the Privacy Policy.
8. Availability and support
We work to keep Voza available and fast, but the service is provided without a guarantee of continuous availability, unless a written contract sets another commitment. Voza depends on third parties, such as WhatsApp, Meta and hosting, payment and email providers, and may undergo maintenance. Support is provided through the channels shown on the website and in the dashboard.
9. Personal data
For the messages and calls of your numbers, you decide which data is processed and why: you are the controller, and Voza processes that data on your behalf, as a processor, under the Data Processing Agreement. The data of your own account is processed by Voza as described in the Privacy Policy. You are responsible for having a legal basis to talk to your contacts and for telling them when calls are recorded.
10. Intellectual property
Voza, its code, its brand and its documentation belong to Voza. These terms give you the right to use the service while the account is active, without transferring any other right. The content of your messages remains yours. WhatsApp is a trademark of Meta Platforms, Inc.; Voza is not affiliated with, endorsed by or sponsored by Meta.
11. Liability
- You are responsible for the content you send, for how you use Voza and for complying with the laws that apply to your business.
- Voza is not liable for decisions by WhatsApp or Meta about your numbers, for failures of third parties beyond our control, or for lost profits or indirect damages.
- To the maximum extent permitted by law, Voza's total liability for any claim related to the service is limited to the amount you paid Voza in the 12 months before the event.
12. Changes to these terms
We may update these terms. When a change is material, we give notice by email or in the dashboard at least 15 days in advance. If you do not agree, you may cancel before the change takes effect; continuing to use Voza after that means accepting the new terms.
13. Governing law and jurisdiction
These terms are governed by the laws of the country where Voza is based, shown below, and any dispute will be settled in the courts of that place, except where the law of the customer's country guarantees another jurisdiction. Before going to court, the parties will try to settle the disagreement through direct negotiation for 30 days.
